Urban Yard (“Urban Yard,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information you provide to us.

Information You Provide

Depending on how you interact with Urban Yard, this may include:

Payment Information

When you purchase a membership, pass, event package, merchandise, food or beverage, or another product or service, payment information may be collected and processed by third-party payment processors.

Urban Yard may receive transaction information such as the amount paid, transaction date, payment status, customer name, and limited payment-method information. Full payment-card information may be collected and maintained directly by the applicable payment processor rather than Urban Yard.

When you access our website or online services, we or our service providers may automatically collect information such as:

3. Dog Registration Information

Urban Yard requires certain dogs using its off-leash facilities to be registered and may require documentation demonstrating compliance with Urban Yard's vaccination and eligibility requirements.

Information submitted as part of dog registration may be processed through third-party registration or membership-management platforms.

We use this information primarily to administer the dog-registration program, verify eligibility, maintain customer and dog profiles, communicate with dog owners, and promote the safe operation of the off-leash area.

Information regarding a dog's vaccinations or veterinary history relates to the animal and should not be interpreted as human medical information.

4. Text Messages and Email Communications

If you provide your telephone number, we may use it for account verification, service-related communications, registration information, or other communications you request or authorize.

One-time verification messages may be required to access certain third-party registration systems.

We will send recurring promotional text messages only when authorized or otherwise permitted by applicable law. Consent to receive promotional text messages is not required as a condition of purchasing goods or services unless specifically disclosed.

You may opt out of recurring marketing text messages by replying STOP to the applicable message.

If you subscribe to promotional emails, you may unsubscribe by using the unsubscribe link included in the email or by contacting us.

You may continue to receive non-promotional communications that are necessary to administer an active transaction, registration, membership, or account.

Urban Yard - Dog Park Membership, Assumption of Risk, Release of Liability & Indemnification Agreement

PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS. BY ENTERING URBAN YARD, USING THE OFF-LEASH DOG PARK, PURCHASING OR USING A MEMBERSHIP OR DAY PASS, OR ELECTRONICALLY ACCEPTING THIS AGREEMENT, YOU ACKNOWLEDGE AND AGREE TO THE TERMS BELOW.

Urban Yard is a DBA operated by Project Interim, LLC (“Urban Yard,” “we,” “us,” or the “Company”) located at:

Dog Park Rules

To help maintain a safe and enjoyable environment for guests and dogs, all visitors must comply with the following rules.

1. 21+ Venue

Urban Yard is a 21+ venue where alcohol is served. Valid identification may be required for entry.

2. Minimum Dog Age

Dogs must be at least 4 months (16 weeks) old to enter.

3. Spay and Neuter Requirement

Dogs over 8 months old must be spayed or neutered.

4. Vaccinations

Dogs must be current on the following vaccinations:

• Rabies

• DHPP

• Bordetella

Proof of required vaccinations must be on file with Urban Yard.

5. Maximum Number of Dogs

A maximum of two dogs per person is permitted unless otherwise approved by Urban Yard.

6. No Outside Dog Food or Toys

Outside dog food, treats, toys, chews, or similar items are not permitted in the off-leash area.

7. Collars, Harnesses, and Leashes

Dogs may wear flat-buckle or quick-release collars with current identification tags.

Prong collars, choke collars, martingale collars, harnesses, and leashes must be removed before entering designated off-leash areas.

Guests must keep a leash readily available at all times.

8. Supervise Your Dog

You are responsible for your dog at all times.

Guests must:

• Actively supervise their dog;

• Remain on the Premises while their dog is present;

• Maintain the ability to retrieve or control their dog;

• Pick up and properly dispose of dog waste;

• Keep a leash readily available; and

• Leash their dog when entering or leaving off-leash areas.

The presence of Urban Yard staff does not transfer responsibility for your dog to Urban Yard.

9. Dog Behavior

Dogs must be reasonably friendly, social, and suitable for an off-leash environment.

Dogs displaying aggression, dangerous behavior, uncontrolled behavior, repeated excessive mounting, or other conduct Urban Yard considers unsafe or disruptive may be separated, leashed, suspended, or removed.

10. Follow Staff Instructions

Guests must promptly follow instructions from Urban Yard staff.

Staff may redirect, separate, leash, restrain, or remove a dog when staff determine intervention is appropriate for safety or operational reasons.

Staff intervention does not relieve a guest of responsibility for their dog.

11. Stay With Your Dog

Dogs may not be left unattended.

Guests must accompany their dogs while on the Premises and leash their dogs before leaving designated off-leash areas.

12. Foster Dogs

Foster dogs are permitted only with the consent of the applicable foster or rescue organization and must meet all other Urban Yard requirements.

Three-Strike Policy

Urban Yard maintains a “3 Strikes — You Are Out” policy to promote the safety of all guests and dogs.

A strike may be issued for unsafe, aggressive, disruptive, or inappropriate behavior or for violations of Urban Yard rules.

More than one strike may be issued for a single incident depending on the seriousness of the incident, as determined by Urban Yard staff.

After receiving three strikes:

• The dog will be prohibited from entering Urban Yard for at least six months;

• Completion of the six-month period does not automatically restore admission privileges; and

• Readmission may occur only after a re-evaluation and approval by Urban Yard.

Urban Yard retains sole discretion regarding whether a dog may return after suspension.

Immediate Removal

The three-strike system does not prevent Urban Yard from taking immediate action.

Urban Yard reserves the right to refuse admission, refuse service, suspend or terminate a membership, or temporarily or permanently remove any guest or dog at its discretion when Urban Yard determines such action is appropriate for safety, rule compliance, business operations, or the welfare of guests or animals.

Immediate removal may occur regardless of a dog's current strike status.

Assumption of Risk and Liability Waiver

Off-Leash Dog Park Risks

I understand and acknowledge that interacting with dogs and participating in an off-leash dog environment involves inherent and significant risks.

Dogs are animals whose behavior may be unpredictable regardless of breed, size, age, training, temperament, or previous behavior.

Risks associated with Urban Yard may include, but are not limited to:

• Dog bites;

• Dog fights;

• Scratches and puncture wounds;

• Dogs running into or knocking down people;

• Dogs colliding with other dogs, furniture, fencing, gates, or other objects;

• Slips, trips, and falls;

• Injuries occurring while attempting to separate or control dogs;

• Escape or loss of a dog;

• Illness or transmission of communicable conditions;

• Injury or death of a person or animal;

• Property damage;

• Acts or omissions of other guests;

• Failure of another guest to properly supervise their dog;

• Conditions of outdoor surfaces, turf, pavement, furniture, fencing, gates, or equipment;

• Staff efforts to redirect, separate, restrain, leash, or remove a dog;

• Weather or environmental conditions; and

• Risks associated with the presence or consumption of alcoholic beverages.

Urban Yard cannot guarantee the behavior, training, temperament, health, vaccination status, or suitability of any other dog or guest.

Voluntary Assumption of Risk

I KNOWINGLY AND VOLUNTARILY ACCEPT AND ASSUME THE RISKS ASSOCIATED WITH MY PRESENCE AND MY DOG'S PRESENCE AT URBAN YARD.

This includes risks that are known or unknown, anticipated or unanticipated, obvious or hidden, and risks arising from dogs, other guests, conditions on the Premises, or the ordinary negligence of Urban Yard or another Released Party.

I assume these risks for myself, my dog or dogs, and my personal property.

Release of Liability — Including Ordinary Negligence

TO THE FULLEST EXTENT PERMITTED BY WASHINGTON LAW, I RELEASE, WAIVE, AND DISCHARGE PROJECT INTERIM, LLC DBA URBAN YARD, ITS MEMBERS, OWNERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, REPRESENTATIVES, SUCCESSORS AND ASSIGNS, AND THE OWNER, LANDLORD, AND PROPERTY MANAGER OF THE PREMISES (COLLECTIVELY, THE “RELEASED PARTIES”) FROM CLAIMS ARISING OUT OF OR RELATED TO MY OR MY DOG'S PRESENCE AT OR USE OF URBAN YARD, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY.

This release includes claims involving:

• Personal injury;

• Dog bites or other animal-related injuries;

• Illness;

• Death;

• Property damage;

• Injury or death of a dog;

• Conditions of the Premises;

• Admission or presence of another guest or dog;

• Failure to identify or prevent unsafe dog behavior;

• Failure to prevent a dog fight, bite, escape, or other incident;

• Staff supervision or lack of supervision;

• Enforcement or non-enforcement of Urban Yard rules; and

• Staff decisions regarding whether or when to intervene.

I UNDERSTAND THAT I AM GIVING UP CERTAIN RIGHTS TO SEEK DAMAGES FROM THE RELEASED PARTIES, INCLUDING FOR CLAIMS ARISING FROM THEIR ORDINARY NEGLIGENCE.

This release does not apply to gross negligence, willful misconduct, intentional misconduct, or liability that cannot legally be waived under Washington law.

Covenant Not to Sue

To the fullest extent permitted by law, I agree not to bring or maintain a lawsuit against a Released Party for a claim that I have released under this Agreement.

This provision does not apply to claims that cannot legally be waived.

Responsibility for Your Dog

You remain responsible for your dog's actions at all times.

You may be legally responsible for injuries or damage caused by your dog, including:

• Injuries to another guest;

• Injuries to another dog or animal;

• Dog bites;

• Property damage; or

• Damage to Urban Yard's facilities or equipment.

Indemnification

I AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE RELEASED PARTIES FROM CLAIMS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND REASONABLE ATTORNEYS' FEES ARISING OUT OF OR RELATED TO:

• My conduct;

• My violation of Urban Yard rules;

• My dog's conduct;

• An injury caused or allegedly caused by my dog;

• Damage caused or allegedly caused by my dog; or

• A claim brought by another person arising from my conduct or my dog's conduct.

This includes claims arising from dog bites, fights, scratches, collisions, attacks, or property damage.

This provision does not require indemnification for liability resulting solely from a Released Party's gross negligence or willful misconduct.

Dog Health and Vaccination Representation

By bringing a dog to Urban Yard, I represent that the dog:

• Meets Urban Yard's age requirements;

• Meets Urban Yard's spay/neuter requirements;

• Is current on required Rabies, DHPP, and Bordetella vaccinations;

• Has accurate vaccination information on file;

• Is reasonably healthy;

• Is not known to have a contagious or communicable condition that may endanger other animals;

• Is not subject to a quarantine or legal restriction that prevents its presence at Urban Yard; and

• Is, to the best of my knowledge, suitable for an off-leash environment.

I agree to update Urban Yard if information regarding my dog's health, vaccination status, or eligibility materially changes.

Alcohol and Dog Supervision

Alcoholic beverages may be served at Urban Yard.

If I choose to consume alcohol, I remain responsible for determining whether I can safely supervise and control my dog.

Alcohol consumption does not reduce or transfer my responsibility for my dog.

Guests whose level of impairment interferes with their ability to safely supervise a dog, comply with staff instructions, or safely remain on the Premises may be required to leave.

Staff Intervention

I authorize Urban Yard staff to take reasonable action to redirect, separate, leash, restrain, or remove my dog when staff determine intervention is appropriate.

I understand that intervening in dog interactions may itself involve risk and that staff intervention cannot guarantee that an injury will be prevented.

Staff intervention does not transfer ownership, custody, or primary responsibility for my dog to Urban Yard.

Emergency Veterinary Care

If my dog becomes injured or ill and I cannot immediately respond, I authorize Urban Yard to take reasonable emergency measures, which may include contacting:

• An emergency veterinarian;

• Animal control;

• An emergency contact; or

• Another appropriate service provider.

Urban Yard is not a veterinary provider and does not undertake responsibility for diagnosing or treating an animal.

I am responsible for veterinary care, transportation, or related expenses incurred on behalf of my dog unless otherwise required by law.

Personal Property

Guests are responsible for their personal belongings.

To the fullest extent permitted by law, Urban Yard is not responsible for lost, stolen, misplaced, or damaged property, including property damaged by dogs.

No Guarantee of Safety

Urban Yard uses rules, vaccination requirements, registration procedures, fencing, staff presence, and other measures intended to reduce risk.

These measures cannot eliminate the inherent risks of an off-leash dog environment.

Urban Yard does not guarantee that:

• A dog will not bite or injure another person or dog;

• Another guest will properly supervise their dog;

• A dog will not escape;

• Disease transmission will not occur;

• Staff will observe every dog interaction;

• Staff will intervene before an incident occurs; or

• The Premises will be free of every possible hazard.

Media Release

Unless you have separately opted out where an opt-out is made available, you acknowledge that photographs or video may be taken in public areas of Urban Yard.

Where you separately consent to Urban Yard's media release, you authorize Urban Yard to use photographs or recordings containing you or your dog for marketing, advertising, website, social-media, promotional, and other lawful business purposes without compensation.

Severability

If any provision of this Agreement is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary.

The remaining provisions will remain in effect.

Governing Law and Venue

This Agreement is governed by the laws of the State of Washington.

To the extent permitted by law, any dispute arising from this Agreement or use of Urban Yard shall be brought in a court of competent jurisdiction in King County, Washington, or the applicable federal court serving King County.

Continuing Agreement

Unless Urban Yard requires execution of a replacement agreement, this Agreement applies to each visit to Urban Yard and each visit involving a dog registered under your account.

Urban Yard may require a new waiver if its facilities, policies, services, ownership, rules, or waiver terms materially change.
